H.F. 4530 Summary

• Governor must withhold or withdraw approval of transferring Minnesota National Guard to federal control unless there is a military invasion of the United States, an insurrection, or a declaration of war by Congress.

• Governor must examine every federal order placing the National Guard on federal active duty to determine whether it is constitutional under Article I, Section 8, Clause 15 of the U.S. Constitution.

• Governor must take all appropriate action to prevent the National Guard from being placed or kept on federal active duty if the governor determines a federal order is unconstitutional.

• Governor must submit a report to legislative committees with jurisdiction over military affairs within 30 days summarizing the review of each federal order and any actions taken in response.

• This section is effective the day following final enactment.
