School boards may renew expiring referendums for one year by board action instead of holding an election, if the referendum revenue expires in fiscal year 2021 and has not been renewed for fiscal year 2022 and later.

The per-pupil amount of the renewed referendum must equal the expiring amount, or if the expiring referendum was inflation-adjusted, must be adjusted in the same manner as if it had continued.

School boards must adopt a written resolution authorizing the renewal by August 15, 2020, after informing residents and providing opportunity to submit written comments.

The resolution becomes effective 60 days after adoption and must be submitted to the commissioner of education and county auditor by September 15 of the calendar year in which the levy is certified.

The renewed referendum expires in the last fiscal year in which it generates revenue, and this provision is effective for fiscal year 2022 revenue only.
