Qualifying restaurants with on-sale intoxicating liquor or wine licenses may offer off-sales of malt liquor, hard seltzer, cider, and wine with prepared food take-out orders without obtaining an additional license.

Alcoholic beverages must be sold in original, unopened packaging and limited to 72 ounces total of malt liquor, hard seltzer, and cider, or 750 milliliters of wine per take-out order.

Licensees must verify the customer is at least 21 years old and notify their liability insurance provider of the off-sales activity; no delivery of alcoholic beverages is permitted.

Municipal governments may elect to prohibit these off-sales within their jurisdictions.

Authority to make these off-sales expires when restaurant closure orders under Executive Orders 20-04, 20-18, and 20-33 expire, are terminated, or are rescinded.
