Governor may declare peacetime emergency for initial 5 days without legislative approval when an act of nature, technological failure, terrorist incident, industrial accident, hazardous materials accident, or civil disturbance endangers life and property with inadequate local resources.

Peacetime emergency may be extended by Executive Council resolution for up to an additional 25 days for a cumulative total of 30 days.

Extensions beyond 30 days require majority vote approval from both houses of the legislature, with each extension limited to up to an additional 14 days per request.

Governor must provide at least three days' notice to legislative leaders if intent to extend beyond 30 days when legislature is not in session, triggering mandatory convening of both houses.

Governor prohibited from allowing peacetime emergency declaration to expire and declaring a new emergency for the same situation to circumvent legislative approval requirements.
