H.F. 803 Summary

• Establishes a 13-member Americans with Disabilities Act Notice to Businesses Working Group to develop recommendations for notifying business owners that standard building code inspections and approvals do not guarantee compliance with accessibility requirements under the Americans with Disabilities Act, Minnesota Human Rights Act, or state building codes.

• Working group membership includes representatives from the Minnesota Department of Human Rights, Minnesota State Council on Disability, Association of Minnesota Building Officials, League of Minnesota Cities, Association of Minnesota Counties, American Society of Civil Engineers, American Institute of Architects, American Society of Landscape Architects, Minnesota Chamber of Commerce, National Federation of Independent Business, MetroIBA, Minnesota Disability Law Center, and the Commissioner of Labor and Industry as chair.

• Working group must develop recommendations on the content, form, and timing of notices to businesses and identify which entity or entities should provide the notices.

• Commissioner of Labor and Industry shall provide administrative support and meeting space; working group members serve without compensation or expense reimbursement.

• Working group appointments must be made by July 1, 2019, with the first meeting by August 30, 2019, and a report with findings, recommendations, and draft legislation submitted to legislature by January 15, 2020.
