Peace officers may issue citations to motor vehicle operators for work zone violations based on a report from a qualified work zone flagger, even if the violation did not occur in the officer's presence.

A qualified flagger report must include a description and license plate number of the vehicle, the time of the incident, and the citation must be issued within four hours of the reported violation.

Work zone flagger reports qualify as probable cause if the flagger has completed training covering flagging operations, equipment, traffic laws, vehicle identification, and report delegation procedures.

Violations of work zone flagger instructions result in a $300 fine plus applicable surcharges, with vehicle owners and lessees potentially liable as petty misdemeanors.

The effective date is August 1, 2019, applying to all violations occurring on or after that date.
