SF3866 Summary

• Prohibits civilly committed sex offenders from possessing firearms and consolidates mandatory firearm transfer provisions across domestic abuse, child abuse, harassment, stalking, and assault convictions.

• Clarifies felony drive-by shooting penalties: firing at unoccupied vehicle/building carries up to 3 years imprisonment or $6,000 fine; firing at occupied vehicle/building or person carries up to 10 years imprisonment or $20,000 fine.

• Makes it a felony for criminal gang members to possess pistols in public without a permit to carry, effective August 1, 2020.

• Expands permit to carry background checks for noncitizen applicants to include Immigration Alien Query (IAQ) checks and requires applicants to provide country of birth and alien number.

• Increases penalties for transferring firearms to ineligible persons: basic violation is a felony with up to 2 years imprisonment or $4,000 fine; aggravated offense when weapon used in crime carries up to 5 years imprisonment or $10,000 fine.

• Prohibits local governments from disarming peace officers who are in good standing and not under investigation.
