• Requires industrial hemp growers to obtain a license from the commissioner and include attestation of whether hemp will be transported, processed, distributed, or sold outside Minnesota in their application.

• Exempts applicants from federal compliance requirements if they attest their industrial hemp will not leave Minnesota or are otherwise exempt from federal requirements.

• Creates new statute section 31.98 authorizing sale of hemp extract food products that contain no more than 0.3 percent delta-9 tetrahydrocannabinol on a dry-weight basis and do not contain unsafe contaminants.

• Requires hemp extract food products to include a certificate of analysis from an independent testing laboratory and specific labeling with manufacturer information, cannabinoid amounts, and FDA disclaimers.

• Clarifies that food and beverages containing hemp extract are not adulterated and prohibits restriction or sale limitations based solely on hemp extract inclusion.
