S.F. No. 4130 - Workers' Compensation Bill Summary

• Adopts recommendations from the 2020 Workers' Compensation Advisory Council, including amendments to self-insurer financial requirements, common claims fund levels for group self-insurers, and actuarial valuation standards effective January 1, 2021.

• Establishes presumption of occupational disease for COVID-19 infections among certain workers (peace officers, firefighters, paramedics, nurses, correctional officers, health care workers, and childcare providers for first responders) with specified documentation requirements.

• Creates a workers' compensation COVID-19 reimbursement fund of $375 million in fiscal year 2020 (from federal coronavirus relief funds) to reimburse workers' compensation providers for COVID-19-related costs for employees in presumptive classes, with reimbursements distributed on first-come, first-served basis through December 30, 2020.

• Modernizes workers' compensation administration by requiring electronic filing through CAMPUS system, establishing public access to employer insurance coverage data, and updating reporting requirements for insurers and self-insurers.

• Increases payment to deceased employee estates from $50,000 to $60,000 when no dependents exist, payable within 14 days of notice of appointment of personal representative or affidavit of collection.
