Amends Minnesota Statutes 2018, section 124D.03 to modify nonresident pupil enrollment limits for early childhood special education programs and special education secondary transition programs for students with disabilities ages 18 to 21.

School boards may limit nonresident pupil enrollment to no less than the lesser of: (1) one percent of total enrollment at each grade level, or (2) the number of district residents at that grade level enrolled in nonresident districts.

Districts that limit nonresident enrollment must report to the commissioner by July 15 on the number of nonresident pupils denied admission.

School boards may consider program capacity when adopting acceptance and rejection standards, including capacity of early education programs, transition programs, classes, or school buildings for kindergarten through grade 12.

Prohibits rejection of nonresident enrollment applications based on previous academic achievement, athletic or extracurricular ability, disabling conditions, English language proficiency, disciplinary history, or district of residence, except when district of residence is part of an approved achievement and integration program.

Both sections are effective July 1, 2020.
