SF 4210 - Matthew's Law Summary

• Requires the Peace Officer Standards and Training Board to adopt a model policy for confidential informant use by January 1, 2021, developed in consultation with law enforcement, prosecutors, and treatment/mental health organizations.

• Mandates all state and local law enforcement agencies establish written policies identical or substantially similar to the board's model policy and certify annual compliance.

• Model policy must include minimum standards for informant records, conditions and procedures, compensation, supervisory oversight, protective measures, training, identity security, and deactivation procedures.

• Requires at least seven hours of preservice training for all peace officer candidates on confidential informant recruitment and use before January 1, 2021, and mandates at least seven hours of in-service training every five years.

• Authorizes the board to conduct compliance inspections of agency policies and impose licensing sanctions or seek injunctive relief for non-compliance; effective upon final enactment.
