Beginning January 1, 2022, covered establishments licensed under food/health chapters may not process, prepare, sell, or provide food or beverages in disposable food service containers composed in whole or in part of polystyrene foam.

Exceptions to the polystyrene container prohibition include emergencies for public health or safety, consumer-owned containers brought to establishments, and retail sale of prepackaged wholesale items.

Covered establishments providing beverages at state or local government facilities and functions must not provide beverage stirrers composed of plastic.

"Covered establishment" includes any licensed food operation that stores, prepares, serves, or delivers food for human consumption and relinquishes possession to a consumer.

Polystyrene foam coolers and ice chests used for processing or shipping seafood are exempted from the container prohibition.
