S.F. No. 4428 Summary

• Prohibits nonwoven disposable products (designed for bathroom/toileting use) from being advertised, packaged, or labeled as "flushable," "septic safe," or "sewer safe" unless they meet Federal Trade Commission flushability standards or an approved INDA industry code of practice.

• Requires all nonwoven disposable products sold in Minnesota to comply with the most recent INDA code of practice for product labeling as approved by the Pollution Control Agency commissioner.

• Manufacturers violating the prohibition or labeling requirements face civil penalties of $100 per prepackaged unit offered for sale, up to a maximum of $5,000, and may be subject to injunction.

• Exempts television and radio broadcasters, newspaper publishers, wholesalers, and retailers from liability for advertising or distributing non-compliant products.

• Allows manufacturers to exhaust existing non-compliant stock through distribution or sale to wholesalers or retailers until January 1, 2021; law becomes effective August 1, 2021.
