School boards may renew an expiring referendum for one year by board action if the referendum revenue expires in fiscal year 2021 and has not been renewed for fiscal year 2022 and later.

The per-pupil amount of the renewed referendum must equal the amount expiring, or if the expiring referendum was inflation-adjusted, must use the same inflation-adjustment methodology.

School boards must adopt a written resolution authorizing the renewal by August 15, 2020, after informing district residents and providing an opportunity to submit written comments.

Districts must submit a copy of the adopted resolution to the commissioner of education and county auditor no later than September 15 of the calendar year in which the levy is certified.

A renewed referendum under this section expires in the last fiscal year in which it generates revenue for the school district, with the provision effective only for fiscal year 2022 revenue.
