Commissioner of human services shall temporarily reimburse disability services providers at 50 percent of the standard rate for fixed costs of eligible services not provided while the commissioner of health's temporary guidelines limiting gatherings of people with complex health issues are in effect.

Eligible services include adult day services, day treatment and habilitation, day support services, prevocational services, structured day services, employment exploration services, employment development services, and employment support services.

Reimbursement applies to services that would have been provided to qualified individuals based on service authorizations approved or in effect on March 16, 2020, assuming recipients would not have been absent.

Excess spending provisions under Minnesota Statutes sections 256B.0916, subdivision 11, and 256B.49, subdivision 26, are suspended for any excess spending attributable to this reimbursement program.

The section is effective the day following final enactment and applies retroactively to eligible services not provided but would have been provided on or after March 16, 2020.
