Commissioner of Employment and Economic Development shall identify low-risk businesses by type or category that can operate safely during COVID-19 peacetime emergencies and make a list available on the department website by April 30, 2020.

Applicants must submit a plan for safe operation including business information, strategies to minimize physical interactions, health and hygiene measures, protective equipment use, and agreement to comply with testing protocols and CDC recommendations.

Commissioner must issue or deny a waiver within five business days of receiving a complete application, with technical assistance from the commissioner of health.

Businesses receiving waivers must post them visibly at their location and adhere to their submitted safety plans.

Waivers may be rescinded if businesses fail to follow their approved safe operation plans; this section is effective the day following final enactment and applies only to emergencies ending by January 31, 2021.
