Local government units may not require applicants to resubmit information previously provided in prior small wireless facility permit applications with specific reference.

Local government units must process small wireless facility permit applications on a nondiscriminatory basis and may limit information requests to that reasonably necessary for compliance with health, safety, welfare regulations and Federal Communications Commission radio frequency exposure requirements.

Wireless support structures installed in public rights-of-way after May 31, 2017 may not exceed 50 feet above ground level unless local government agrees to greater height subject to local zoning regulations.

Local government units must issue or deny small wireless facility permits within 90 days of application filing, or the permit is automatically issued; local government units may request missing information only within the first 30 days and may extend the deadline by 30 days if receiving more than 20 applications in a seven-day period.

Commissioner of health must conduct a study on potential health and environmental impacts of fifth generation wireless technology, examining biological effects of electromagnetic radiation at higher frequencies, with results due by January 15, 2021.
