Commissioner of Employment and Economic Development shall identify low-risk business categories that can safely operate during COVID-19 peacetime emergency and publish list on department website by April 30, 2020.

Low-risk businesses must submit application with safe operation plan including business details, procedures to minimize physical interactions, health and hygiene measures, protective equipment use, and agreement to comply with testing protocols and CDC recommendations.

Commissioner must issue or deny waiver within five business days of receiving complete application, with health commissioner providing technical assistance and written notice of any incompleteness provided to applicant.

Businesses receiving waiver must post it visibly at their place of business and comply with the safe operation plan filed with the commissioner or face rescission of waiver.

Peacetime public health emergency period ends no later than January 31, 2021; effective date is day following final enactment.
