HF1 Summary

• Attorney general assumes exclusive prosecutorial authority over all peace-officer-involved death cases, with county attorneys able to assist upon request.

• Establishes independent Use of Force Investigations Unit within Bureau of Criminal Apprehension to investigate officer-involved deaths and officer misconduct cases, with findings publicly available within 30 days of final appeal.

• Modifies deadly force standards to require officers use force only when necessary to protect against imminent death or great bodily harm, and prohibits use of force based solely on danger a person poses to themselves.

• Requires objective, racially and ethnically responsive juvenile detention risk assessment instruments before detaining children, with effective date of August 15, 2021.

• Limits money bail for misdemeanor offenses by requiring release on personal recognizance unless court finds substantial likelihood defendant will not appear or poses threat to victim safety, effective August 1, 2020.
