Commissioner of human services shall temporarily reimburse disability services providers at 50 percent of the standard rate for fixed costs of eligible services that were not provided during commissioner of health's temporary gathering restrictions.

Eligible services include adult day services, day treatment and habilitation, day support services, prevocational services, structured day services, employment exploration services, employment development services, and employment support services under Minnesota Statutes section 256B.4914.

Reimbursement applies to services authorized or in effect on March 16, 2020 that would have been provided to qualified individuals, with the assumption that recipients would not have been absent.

Reimbursement continues until the commissioner of health withdraws temporary guidelines related to limiting gatherings of people with complex health issues.

Excess spending provisions under Minnesota Statutes sections 256B.0916 and 256B.49 are suspended for excess spending attributable to this reimbursement, effective retroactively to March 16, 2020.
