The board must adopt an updated comprehensive model policy on use of force by peace officers by September 1, 2020, and distribute it to all law enforcement agencies in the state.

The model policy must include a duty for peace officers to intercede when observing another officer using clearly unreasonable force, and a duty to report illegal use of force by fellow officers to their chief law enforcement officer.

The policy must prohibit carotid control and neck restraints or chokeholds that restrict airways, except when a person is committing a violent act that imminently threatens an officer or another with great bodily harm or death, and even then requires considering less lethal measures first.

Each chief law enforcement officer must establish and enforce a policy identical or substantively similar to the model policy by November 1, 2020, and certify compliance to the board.

The board has authority to inspect law enforcement agency policies for compliance through complaint-based or random selection processes, and agencies must maintain written records of compliance with the new requirements.
