Commissioner of human services shall temporarily reimburse disability services providers at 50 percent of the standard rate for fixed costs of eligible services that were not provided during COVID-19 health gathering restrictions.

Eligible services include adult day services, day treatment and habilitation, day support services, prevocational services, structured day services, employment exploration services, employment development services, and employment support services.

Reimbursement applies to services authorized or approved as of March 16, 2020, with the assumption that recipients would not have been absent during the gathering restrictions.

Excess spending provisions under Minnesota Statutes sections 256B.0916 and 256B.49 are suspended for any overspending attributable to this reimbursement program.

Effective retroactively to eligible services not provided on or after March 16, 2020, and continues until the commissioner of health withdraws temporary guidelines limiting gatherings of people with complex health issues.
