Requires the commissioner to approve requests by municipal utilities and cooperative electric associations to adjust their annual energy-savings goals unless the request is made in bad faith and the requester has made no credible attempt to meet the existing goal.

Prohibits waste heat recovery converted to electricity from counting toward a municipal utility's or cooperative electric association's annual energy-savings goal.

Allows public utilities (but not municipal utilities or cooperative associations) to include waste heat recovery converted to electricity projects in their energy conservation plans in addition to a minimum one percent energy-savings goal.

Maintains the baseline 1.5 percent annual energy-savings goal for utilities and associations based on gross annual retail energy sales, calculated on a three-year weather-normalized average.

Exempts small utilities from these requirements: cooperative electric associations with fewer than 5,000 members, municipal utilities with fewer than 1,000 retail electric customers, and municipal utilities with less than 1 billion cubic feet in annual natural gas throughput sales.
