Governor may declare peacetime emergency without legislative approval for up to 5 days when act of nature, technological failure, terrorist incident, industrial accident, hazardous materials accident, or civil disturbance endangers life and property with inadequate local resources.

Peacetime emergency may be extended by Executive Council resolution for up to 25 additional days for a cumulative total of 30 days without legislative approval.

Extensions beyond 30 days require majority vote approval by both houses of the legislature, with each extension limited to 14 days and renewable upon governor request with additional legislative approval.

Governor must provide at least 3 days' notice to legislative leaders if legislature is not in session and governor seeks to extend emergency beyond 30 days, requiring immediate convening of both houses.

Governor prohibited from allowing peacetime emergency declaration to expire and declaring new emergency for same situation to circumvent legislative approval requirements; multiple separate emergencies are allowed but subject to same legislative approval rules for extensions.
