Prohibits peace officers from using tear gas as a means to control or disperse crowds during the performance of their duties.

Prohibits chief law enforcement officers from authorizing the use of tear gas for crowd control purposes.

Maintains existing prohibitions on using tear gas against peace officers and using tear gas in immobilizing concentrations against other persons.

Allows law enforcement agencies, peace officers, the National Guard, and reserves to possess and use tear gas for official duties other than crowd control, with counties and municipalities able to impose licensing requirements on sellers.
