SF 40 Summary

• Expands Peace Officer Standards and Training Board membership from 15 to 17 members by adding two additional public members.

• Requires board adoption of updated use of force policy by September 1, 2020, prohibiting carotid control and neck restraints except when person poses imminent threat of great bodily harm or death, and mandating officer duties to intercede against excessive force and report illegal use of force.

• Establishes crisis intervention, mental illness crisis, and autism training requirements for peace officers with specific learning objectives and continuing education credits, including mandatory preservice training on autism by July 1, 2021.

• Creates mandatory reporting of law enforcement use of force incidents resulting in serious bodily harm or death to the Bureau of Criminal Apprehension, with annual summary reports submitted to legislative committees.

• Appropriates $600,000 for fiscal year 2021 to support autism training ($200,000), crisis intervention training reimbursement ($200,000), and two pilot projects combining mobile crisis mental health services with municipal law enforcement ($200,000).
