HF 13 Summary: Workers' Compensation Law Amendments

• Adopts recommendations from the 2020 Workers' Compensation Advisory Council, implementing changes to self-insurer requirements, security deposits, and actuarial standards for private and commercial self-insurance groups.

• Requires group self-insurers with 5+ years in existence to maintain common claims fund levels at the greater of one year's claim losses or one-third of security deposit posted with Department of Commerce.

• Eliminates present value discounting for actuarial opinions determining future liabilities for self-insurers terminating coverage after April 1, 1998, and establishes January 1, 2021 effective date for related actuarial valuation changes.

• Expands occupational disease and mental impairment presumptions for first responders and healthcare workers, including presumption for COVID-19 contraction in specified employment categories with requirements for confirmation and employment verification.

• Establishes electronic filing requirements through CAMPUS system, creates public data access for workers' compensation insurance information, enhances attorney access procedures to division files, and repeals requirement for certified public accountant financial statements for group self-insurers.
