State shall reimburse certified community behavioral health clinic (CCBHC) providers ineligible for the federal section 223 CCBHC demonstration with state funds using the prospective payment rate if federal approval is not obtained by October 1, 2020.

If the federal section 223 demonstration expires before federal approval of medical assistance reimbursement is obtained, state shall continue paying CCBHC providers using the prospective payment system with state funds.

Starting October 1, 2020, the commissioner shall pay CCBHC providers through monthly supplemental wraparound payments until the full prospective payment rate is programmed into the state's Medicaid Management Information System (MMIS).

Upon federal approval of CCBHC reimbursement, the state general fund shall be reimbursed for the federal share of CCBHC payments made from state funds, retroactive to October 1, 2020.

Commissioner of human services shall submit a report by December 1, 2020, to legislative committees with jurisdiction over health and human services detailing the implementation status and federal approval request progress.
