S.F. No. 1 - Military Veteran Offenders Restorative Justice Sentence

• Courts must determine before guilty plea whether defendants charged with Severity Level 7, D7, or lower offenses acquired the offense due to service-related sexual trauma, traumatic brain injury, post-traumatic stress disorder, substance abuse, or mental health conditions.

• Eligible veterans may receive probation without guilt adjudication and with deferred proceedings, with probation duration not exceeding the maximum sentence for the offense.

• Courts shall give preference to treatment programs with experience treating military veterans and may collaborate with county veterans service officers and the Department of Veterans Affairs to maximize benefits.

• Upon successful probation completion, defendants must be discharged and charges dismissed, with the offense dismissed not constituting a conviction but recorded as "not public" for courts' use in subsequent proceedings.

• Counties and cities may establish veterans pretrial diversion programs allowing prosecutors to dismiss charges after defendants successfully complete treatment recommended by the Veterans Affairs Department or approved treatment providers; effective April 1, 2021.
