• Requires medically fragile pupils who need clinical nursing services at home to receive the same level of care while attending school or during transportation, with options including use of the pupil's existing home nursing provider, school-contracted providers, or school staff.

• Schools and parents or legal guardians must meet to discuss clinical nursing service arrangements, considering the provider's ability to deliver required services, familiarity with the pupil's needs, and impact on home care availability.

• Eligible clinical nursing providers must be licensed by the Board of Nursing under chapter 148, comply with federal law and school district policies including background checks, and enter into agreements establishing expectations for conduct and liability coverage.

• School districts bear no liability for actions of private clinical nursing providers on school premises, and non-employee providers report to and are supervised by their clinical nursing provider employer rather than the school district.
