Prohibits government entities and officials from obtaining, retaining, accessing, or using facial recognition systems or any information derived from such systems.

Prohibits government entities from entering into agreements with private entities to obtain, retain, access, or use facial recognition systems or related information.

Declares data collected in violation of the ban inadmissible as evidence in any court, hearing, or proceeding, and requires deletion of unlawfully obtained data upon discovery.

Allows individuals to pursue injunctive relief, declaratory relief, or writs of mandate against government entities, and entitles victims to recover actual damages with a minimum of $1,000 or $100 per violation, whichever is greater.

Permits violations by government officials to be addressed through retraining, suspension, or termination subject to due process, with prevailing plaintiffs entitled to recover costs and reasonable attorney fees; effective August 1, 2021.
