Governor may declare peacetime emergency for acts of nature, technological failure, terrorist incidents, industrial accidents, hazardous materials accidents, or civil disturbances that endanger life and property when local resources are inadequate.

Peacetime emergency may continue for up to 5 days, then requires Executive Council resolution for extension of up to 25 additional days for a cumulative maximum of 30 days.

Extensions beyond 30 days require majority vote approval from both houses of the legislature, with the governor able to propose additional 30-day extensions subject to legislative approval.

Governor must provide at least 3 days' notice to legislative leaders before calling a special session if seeking to extend a peacetime emergency beyond 30 days while the legislature is not in session.

Governor is prohibited from allowing a peacetime emergency to expire and declaring a new one for the same emergency to circumvent legislative approval requirements.
