Commissioner of health shall conduct inspections to determine whether hospitals granted construction moratorium exceptions continue satisfying the conditions on which the exception was granted, effective July 1, 2021.

Commissioner shall not renew hospital bed licenses issued pursuant to a construction moratorium exception if the hospital or hospital corporate system fails to satisfy the conditions on which the exception was granted, effective for license renewals on or after July 1, 2021.

Hospitals granted construction moratorium exceptions must submit annual reports to the commissioner detailing how they continue to satisfy the conditions of their exception, effective July 1, 2021.

When hospital beds are transferred from a closed facility to another site within a hospital corporate system, transferred beds must first replace beds previously used for behavioral health, mental health, and substance use disorder services before being used for other purposes.
