Commissioner of Human Services shall continue permitting emergency COVID-19 background studies for individuals required under Minnesota Statutes chapter 245C until the peacetime emergency expires, is terminated, or rescinded by proper authority.

Full fingerprint-based background studies must be completed within one year after the peacetime emergency ends for every individual who received an emergency COVID-19 background study retroactively from April 6, 2020.

Emergency COVID-19 background studies waive requirements for fingerprints, photographs, and out-of-state registry checks; only name and date of birth are used to check Minnesota maltreatment and criminal history registries.

Fee for emergency COVID-19 background studies is set at $20.

Commissioner may waive direct contact supervision requirements on a case-by-case basis during emergency COVID-19 background study completion, except for transportation providers and personal care assistants.

Child abuse and neglect registry checks in other states remain required for foster care, adoption, legal guardianship, and children's residential facilities applicants with out-of-state residence history.
