Governor may declare peacetime emergency when an act of nature, technological failure, terrorist incident, industrial accident, hazardous materials accident, or civil disturbance endangers life and property and local resources are inadequate.

Peacetime emergency cannot continue beyond 5 days unless extended by Executive Council resolution for up to an additional 25 days, for a total maximum of 30 days.

Any extension of peacetime emergency beyond 30 days requires approval by majority vote of both houses of the legislature.

If governor seeks to extend emergency beyond 30 days and legislature is not in session, governor must immediately issue a call to convene both houses.

Legislature may terminate peacetime emergency extending beyond 30 days by majority vote of each house; governor retains authority over National Guard under Military Code chapters 190 to 192A.
