Commissioner of human services may enter into value-based purchasing arrangements with drug manufacturers for medical assistance and MinnesotaCare programs based on written agreement with agreed-upon metrics.

Value-based purchasing arrangements may include rebates, discounts, price reductions, risk-sharing, reimbursements, guarantees, shared savings payments, withholds, bonuses, or other things of value.

Commissioner may contract with a vendor to participate in value-based purchasing arrangements, which must be executed in a separate agreement from the Medicaid National Drug Rebate Agreement for covered outpatient drugs.

Participation in value-based purchasing arrangements is voluntary for both drug manufacturers and the commissioner, and arrangements do not alter or modify medical assistance coverage requirements under federal law.

If state plan amendment is required, commissioner must submit to Centers for Medicare and Medicaid Services and delay implementation until approval, but may request proposals from manufacturers during review.
