• Landlords must complete radon testing at least once every five years in all leased residential buildings, performed by a licensed radon professional.

• Landlords must report radon test results to all current tenants within 30 days and to the inspector.

• Landlords must provide prospective tenants and current tenants with the Department of Health's "Radon in Rental Properties" publication and a radon disclosure identifying test dates, locations, results, and any mitigation measures.

• Landlords must complete radon mitigation within 120 days of receiving test results showing elevated radon concentrations, performed by a licensed radon mitigation professional.

• Tenants may pursue court action for violations, with penalties of treble damages or $500 per violation (whichever is greater) plus attorney fees; falsifying test results incurs additional $1,000 punitive damages; the attorney general may also seek penalties.

• Effective date is December 1, 2022, applying to all residential agreements in effect or entered into on or after that date.
