HF 2522 Summary

• Amends Minnesota Statutes section 609.065 to add a new section 609.067 authorizing use of deadly force during declared states of emergency under sections 12.29 or 12.31.

• Permits deadly force to resist or prevent crimes of violence in an individual's dwelling or owned business, or to resist offenses that imminently expose individuals to substantial or great bodily harm or death.

• Establishes presumption that person using deadly force has reasonable belief of imminent threat if target is unlawfully entering dwelling/business or unlawfully removing occupants, unless target is lawful resident or peace officer acting lawfully.

• Provides immunity from criminal prosecution for individuals using justified force and shifts burden of proof to state in criminal trials to prove defendant's actions were not justifiable.

• Effective August 1, 2021, and applies to uses of deadly force occurring on or after that date.
