H.F. No. 2691 Summary

• Prohibits all Minnesota government entities, subdivisions, agents, designees, and assigns from enforcing any vaccine passport, pass, or credential, regardless of whether imposed by federal act, law, executive order, administrative order, court order, rule, regulation, statute, or ordinance.

• Creates a civil cause of action allowing individuals to sue government entities that violate the prohibition or deprive persons of the right to be free from vaccine passport enforcement.

• Allows courts to award reasonable attorney fees and costs to prevailing parties in such civil actions, except when the state of Minnesota or its subdivisions are the prevailing party.

• Eliminates sovereign, official, and qualified immunity as affirmative defenses in civil actions brought under this provision.

• Adds new Minnesota Statutes section 144.0663 to codify these prohibitions and remedies.
