Landlords are prohibited from filing or proceeding with eviction actions for nonpayment of rent if a tenant has a pending application for rental assistance with a federal agency, state agency, local unit of government, or nonprofit corporation.

Landlords may proceed with or file eviction actions if the tenant has been denied rental assistance or if 45 days have passed since the tenant notified the landlord of a pending application, whichever comes first.

Landlords must wait 15 business days before filing or proceeding with eviction after being notified that rental assistance has been approved, pending distribution of funds.

"Rental assistance" includes funds distributed under specified Minnesota statutes and chapters, federal programs administered by state or local government, and nonprofit programs funded by government for rental assistance purposes.

The law is effective the day following final enactment and applies to evictions filed on or after that date and pending evictions not yet adjudicated at enactment.
