Commissioner of Labor and Industry must develop a disclosure form stating that gas fireplaces pose a burn injury hazard to children from glass contact and recommending safety precautions such as safety screens.

Contractors, remodelers, and mechanical contractors must provide the disclosure to owners at least three days before installing a gas fireplace and prior to repairing or maintaining one.

Sellers must provide the disclosure to buyers as part of residential real estate seller disclosures or as a separate disclosure for commercial real estate; real estate appraisers must include it in written appraisal reports.

Failure to provide the required disclosure is subject to a civil penalty up to $10,000, and repeated violations trigger enforcement action by the attorney general.

Effective date is August 1, 2022.
