Governor may declare peacetime emergency when acts of nature, technological failure, terrorist incidents, industrial accidents, hazardous materials accidents, or civil disturbances endanger life and property and local resources are inadequate.

Peacetime emergency cannot continue beyond 5 days unless extended by Executive Council resolution for up to an additional 25 days, for a total maximum of 30 days.

Any extension of peacetime emergency beyond 30 days requires approval by majority vote of both houses of the legislature.

Legislature may terminate peacetime emergency extending beyond 30 days by majority vote in each house.

If governor seeks to extend peacetime emergency beyond 30 days and legislature is not in session, governor must immediately call a special session to convene both houses.
