School boards must adopt a written policy addressing malicious and sadistic conduct involving race, gender, religion, sexual harassment, sexual orientation, and sexual exploitation by staff or students in public or charter schools.

Policies must apply to students, teachers, administrators, and school personnel, include minimum components from existing statute section 121A.031, and specify disciplinary actions conforming with collective bargaining agreements and sections 121A.41 to 121A.56.

Schools must conspicuously post the policy throughout buildings, provide it to all employees and contractors upon hiring, and include it in student handbooks.

Each school must develop a process for discussing the malicious and sadistic conduct policy with students, parents, and school employees.

"Malicious and sadistic conduct" is defined as creating a hostile learning environment by intentionally injuring another without just cause or engaging in extreme or excessive cruelty.
