Health plan companies must include all amounts paid by enrollees or paid on behalf of enrollees by other persons when calculating contributions toward out-of-pocket maximums or cost-sharing requirements.

Cost sharing is defined as co-payments, coinsurance, or deductibles.

Requirements apply only to the extent permitted by federal law.

Applies to health plans offered, issued, or renewed on or after January 1, 2023.
