H.F. No. 4442 Summary

• Metropolitan Council and specified metropolitan agencies may award up to six percent preference in bid amounts to small targeted group businesses and veteran-owned small businesses.

• Council and agencies may designate contracts for construction work, goods, or services exclusively for small targeted group businesses or veteran-owned small businesses if at least three qualified businesses are likely to respond to solicitation.

• Prime contractors on construction and professional service contracts must set subcontracting goals for small targeted group businesses and veteran-owned small businesses, with waivers available when qualified businesses are not reasonably available.

• Prime contractors must pay subcontractors within ten days of payment receipt and pay 1.5 percent monthly interest on undisputed unpaid amounts, with minimum penalty of $10 per month for balances of $100 or more.

• Effective the day following final enactment and applies in Anoka, Carver, Dakota, Hennepin, Ramsey, Scott, and Washington counties.
