Increases the rate floor for 24-hour customized living services in designated disproportionate share facilities from $119 to $139 per resident per day for elderly waiver participants.

Expands the definition of "facility" to include settings exempt from assisted living licensure under section 144G.08, subdivision 7, clauses (10) to (13), in addition to licensed assisted living facilities.

Changes application submission deadlines from October 1-31 to September 1-30 and designation deadlines from November 15 to October 15 for disproportionate share facility status.

Establishes a partial year implementation process allowing facilities to apply between July 1-31, 2022, for designation as disproportionate share facilities, with commissioner designation by August 15, 2022, and rate floor application from October 1 through December 31, 2022.

Requires removal of all prior rate adjustments under the previous statute effective October 1, 2022, and allows facilities receiving prior adjustments to apply under the new provisions.
