H.F. No. 4816 Summary

• Allows nonresidential property owners to elect that multiunit residential property (apartments, condominiums, duplexes, and triplexes) be subject to special service district charges, effective for districts established or expanded after July 1, 2021.

• Defines multiunit residential property as class 4a apartments, class 1a/4b/4bb condominiums, class 4bb condominium-type storage units, and class 1a/4b duplexes or triplexes, excluding affordable housing units affordable to households at or below 80 percent of area median income.

• Permits nonresidential owners (those holding 50 percent or more of land area and either 50 percent of net tax capacity or subject to 50 percent of service charges) to make elections for new district establishment, in-district expansion, or boundary enlargement to include multiunit residential property.

• Requires that common interest community units may only be included in a district if the district provides services not already provided by the unit owner's association.

• Applies hearing, notice, petition, and veto procedures to all owners and occupants subject to service charges when expanding districts to include multiunit residential property.
