Agencies may increase housing support rates beyond the June 30, 1993 baseline under specific circumstances outlined in paragraphs (a) through (g).

Room and board rates continue during temporary resident absences of up to 18 calendar days per incident (maximum 60 days per year) if reported in advance, with exceptions for emergency absences due to crisis, illness, or injury.

Residents temporarily absent for residential behavioral health treatment or inpatient hospital/nursing facility care may receive continued room and board payments beyond the 18-day limit and may exceed the 60-day annual cap.

Agencies may increase rates by $100 per month for residents in settings under section 256I.04, subdivision 2a, paragraph (b), clause (2), effective July 1, 2021.

Paragraph (d) regarding temporary absence provisions is effective retroactively from December 31, 2020.
