Commissioner of Health shall design a wholesale prescription drug importation program in consultation with commissioners of Human Services and Commerce, stakeholders, and federal officials to comply with 21 U.S.C. § 384

Program must designate a state agency to become a licensed drug wholesaler or contract with one to import safe prescription drugs from Canadian suppliers regulated under Canadian law that meet FDA safety and effectiveness standards

Imported drugs must generate substantial savings for Minnesota consumers, be tracked and traced per federal requirements, and be prohibited from distribution outside Minnesota

Commissioner of Health shall submit program design and recommendations to legislative committees with jurisdiction over health care policy and finance by January 1, 2022

Upon legislation adopting the program, Commissioner shall request federal certification from the U.S. Department of Health and Human Services and seek approvals to allow 340B Drug Pricing Program participants to join without jeopardizing their eligibility
