Commissioner of human services shall establish and administer a Minnesota prescription drug purchasing program for medical assistance and MinnesotaCare enrollees served under fee-for-service and managed care delivery systems.

Commissioner's duties include making prescription drugs available at lowest possible cost, maintaining a preferred drug list, administering prescription drug benefits, and adjudicating pharmacy claims.

Commissioner has authority to adopt a preferred drug list, negotiate prices with drug manufacturers and wholesalers, and develop a drug formulary, with option to contract with external entities to perform these functions.

All pharmacies participating as medical assistance providers and any other pharmacy licensed under Minnesota law willing to accept program terms and conditions shall be enrolled in the program.

Commissioner shall develop recommendations by December 15, 2023, for expanding the program to include health plan company enrollees in consultation with commissioners of commerce and health; program becomes effective January 1, 2023, or upon federal approval, whichever is later.
